General Terms & Conditions

  • These General Conditions of Sale point out the rights and obligations of the user (Hereinafter the “Customer”) relating to the products sold by the company Setian  (Hereinafter the “Company” / Setian ) in the electronic catalogue of the website www.setianjewellery.com using a distance selling system.

  • The contract, established in case of an effective order, the conditions referred to in these general conditions of sale, are concluded in accordance with the regulations of distance selling, as it results in particular from the Federal Law No. 15 of 2020 on Consumer Protection (as amended by Decree-Law No. 5 of 2023) and Federal Decree-Law No. 14 of 2023 on Trading through Modern Technology (E-Commerce Law), as well as the specific provisions referred to hereinafter.

  • The order involves irrevocable acceptance of the general conditions of sale. The Customer declares to have the capacity to conclude this contract i.e. to have reached legal age and not to be under guardianship or to have the power to represent a legal person.

  • The Approval without reserve of these general conditions of sale will consist in the fact, for the Customer, when checking the box "I accept the general conditions of sale". Checking this box will be deemed to have the same value as a handwritten signature on the part of the Customer.

 

We only replace items if they are defective or damaged. If you need to exchange an item for the same item due to a request of change of size, send us an email at sales@setianjewellery.com.

If they have chosen a delivery method other than the standard delivery method, the additional billed charges will not be refunded. - However, we will only accept exchange and refund of Jewellery if all of the following conditions are met:

  1. The product must not have been worn, used, modified, washed, damaged or deteriorated.

  2. The product must not have been made to measure

  3. The product must be returned in its original packaging accompanied by the purchase invoice.

  • Upon Receipt of the returned product, the refund will be made according to the buyer's wishes in the form of a credit note valid for 6 months on the Site or a refund credited directly to his bank account depending on the method of payment used when ordering.

Delivery

Delivery is constituted by the transfer of physical possession to the Customer or control of the Product.

  • The covered delivery area includes, United Arab Emirates, Lebanon, Qatar, Saudi Arabia, France, United Kingdom and Switzerland in partnership with DHL EXPRESS and Aramex. For other countries, the order must be sent directly for review to our sales departments by email to sales@setianjewellery. Our services will take care of validating the order and following up with the Customer.

  • Once you place your order need 4 to 8 weeks to deliver your item, depending on product availability and the delivery country. 

  • Delivery time limits are 5 working days and are counted starting from the date of shipment of the order confirmed by email. Any possible delay related to the customs clearance of the exported goods is not the responsibility of the Company.

  • Absence or Delay in delivery: The Company undertakes to make its best efforts to deliver the products ordered by the Customer within the deadlines specified above. These deadlines are provided for information only.

If, after thirty (30) days and exception cases of force majeure, the Customer has not received the package, the Customer must notify the Company by registered letter with acknowledged receipt or in written in another durable support. In this case, the Company undertakes to reimburse the Customer, within ten (10) working days of the cancellation request.

In accordance with the legislation in force, the transfer of risk takes place with the physical possession or control of the Product by the Customer.

  • Insurance: Each package is insured, regardless of the carrier and the value of the Jewellery (s), so that if a package is lost or damaged during transport, we suggest a delivery of an identical product or else a reimbursement if the Customer prefers, if the product is not immediately available.

  • Tracking: We track each of our shipments and you have the possibility to track your order thanks to a tracking number which is provided via email when your package is dispatched [see above].

  • The ordered product is delivered to the address on the Customer's order form.

  • For security reasons, we are not able to deliver to P. O. Boxes. When the product is delivered, check the content of the products delivered and their conformity with your order before signing the carrier's delivery note. In the event of an anomaly, please let us know your reservations within 5 days by emailing at the following address: info@selimmouzannar.com, otherwise, we cannot be liable. If you are absent during the delivery of your package, you will need to contact the carrier to arrange a new delivery.

  • The delivery address may differ from the billing address.

  • In the event of damage, the Customer expresses his reservations with precision and clarity on the delivery slip, a duplicate of which is sent by the carrier to the Company. In this regard, it is the Customer's responsibility to verify the content, conformity and condition of the product upon delivery. This verification is deemed to have been carried out once the Customer, or a person duly authorized by it, has signed the delivery slip presented by the recipient of the carrier.

  • Despite the care taken in preparing the orders, a product may be missing, or an error may have occurred during the preparation. If you notice such an error, please report it to us by email at sales@setianjewellery.com within 48 hours maximum following receipt of the order.

  • Each order is carefully packaged in a Setian  leather pouch to protect the jewel on a daily basis. We prepare your package by hand, which will be shipped in a white, secure and anonymous cardboard box. In addition to your Jewellery, this package contains an envelope with the certificate of authenticity, the invoice and a card with tips for taking care of your Jewellery.

  • If it is a gift and you do not wish to attach the invoice to it, all you have to do is indicate this during the purchase process by checking the box "This is a gift, do not attach the invoice with the parcel”.

  • The Site is the property of the Company. It is protected by International Copyright Laws and Agreements, as well as other International Intellectual Property Laws and treaties.

  • All rights relating to the Site and to the overall concept of the Company's activity, to their original and innovative character, in particular intellectual property rights on texts, literary and artistic creations, graphics (including photographs) and audiovisual, including advertising, IT developments, HTML developments and other intellectual works and, in general, all creations likely to be protected by intellectual property law such as images, logos, formatting, graphic charter, structure, ergonomics, color codes, typography, fonts, basic graphic elements, graphic organization of the screens, layout, page backgrounds, visual identity of the Site, belong to the Company or are regularly used by the latter, without any limitation.

  • The Customer agrees not to directly or indirectly infringe the Company, the Site, or the rights of the Company.

  • The delivery of the order requires the provision of a certain amount of personal information concerning the Customer, namely his name, first name, postal address, date of birth, phone number and email address. The data collected is necessary for the fulfillment of the Company's obligations towards it, such as the validation of the order, or the execution of the delivery. The Customer not wishing to provide this information will not be able to place an order on the Site.

  • The Customer's data is kept for this sole purpose and the Company undertakes not to use them in any other context, nor to transmit them to third parties, without the express consent of the Customer or outside the cases duly provided. The data controller, except for data relating to payment, is the Company, whose contact details are given in article 2. The contact details of Customers are kept for a period of 3 years starting the end of the Business relationship. These data are kept in secure conditions, according to current technical means.

  • The transmission of information on the Site takes place in a secure context using the protocols in force in the Internet.

  • Payment card numbers are not kept in the Site but in the secured site of our banking institution.

  • In accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) relating to computers, files and freedoms, you have the right to access, rectify, and oppose your personal data. To do so, simply send us a request online, indicating your name (s), first name (s), address and, if possible, your customer reference to sales@setianjewellery.com.

The Use of Cookies

Under its own responsibility or that of a third party engaged for the provision of tracking services, the Site may use cookies when an Internet user browses the Site. Cookies are files sent to the browser by means of a web server in order to record the activities of the Internet user while they are browsing.

  • The use of cookies allows the server where the Site is located to recognize the web browser used by the user in order to facilitate navigation as much as possible, allowing, for example, access to users who have already registered to access the areas, services, promotions or contests which are exclusively reserved for them without having to register for each visit. Cookies are also used to measure audience and traffic metrics as well as to monitor progress and number of entries.

  • Guarantees on the use of cookies: The cookies used by the Site are associated only with anonymous users and their computers and do not provide references allowing the users' personal data to be deduced.

  • Some cookies are used by third parties (e.g. Google) to send the Company data on the effectiveness of its promotions. Cookies do not under any circumstances obtain personal information that can identify a particular user.

The cookies used in the Site have, in any case, a temporary nature, with the sole purpose of making subsequent transmission more efficient. No cookie used on the Site will have an effective period of more than two years.

The Customer has the option of configuring their browser to be notified of the cookies’ reception and to refuse installation in their device.

By eliminating cookies from the Site or by disabling them, the Internet user is at the risk of not being able to access certain features of the Site.

  • In order to use the Site, users are not required to allow the installation of cookies, but they shall restart the session per se in each services whose performance requires prior registration or session start.

  • What types of cookies does the Site use? The Site uses four types of cookies:

  • Technical Cookies: They allow the Internet user to browse the Site and use features such as the shopping cart or the Wishlist.

  • Analysis Cookies: The Site uses Google Analytics cookies to quantify the number of users who visit the Site. These cookies make it possible to measure and analyze the way in which Internet users browse the Site. This information allows the Company to continuously improve its services and to facilitate the purchasing process for users of the Site.

  • Personalization Cookies: When the Internet user browses or purchases on the Site, the Site will remember their preferences (for example, their tastes or the preferred language). Thanks to these cookies it is possible to provide a simpler, faster, and more personalized browsing experience for users.

  • Advertising Cookies: These cookies are used to display important announcements to users. In addition, they limit the number of times each user views an ad and help the Company measure the effectiveness of its advertising campaigns. By browsing the Site, the user accepts that the Company downloads this type of cookies to their device and makes consultations when the user visits the Site in the future.

  • The Site may contain links to other websites, having private policies different to those of the Company. In this sense, the Company assumes no responsibility for the content or practices of linked sites. The Company recommends that users of the Site review the privacy policy of all websites which they may access through the Site.

The Site's servers can automatically detect the IP address and domain name used by users.

  • An IP address is a number automatically assigned to a computer when it connects to the Internet. This information allows the subsequent processing of the data in order to obtain only statistical measurements allowing knowing the number of visits made to the Site, the order of the visits, the access point, etc.

  • To Add the option to disable / modify cookies by configuring the internet browser while indicating that this setting may modify the conditions of access to content or services requiring the use of cookies.

  • These general conditions of sale are governed by UAE law, with the exception of Law number 78-17 of January 06, 1978 (French Law) relating to information technology, files and freedoms, and any other applicable international convention Including the Vienna Convention on the International Sale of Goods of April 11, 1980.

  • In the event of a dispute with a client, the UAE courts are competent.
